01Terms of Use

Acceptance of Terms

By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and all applicable laws. We may update these terms at any time; continued use of the Site after changes are posted constitutes acceptance of the revised terms.

Use of the Site

You may use the Site for your own personal, non-commercial purposes. You agree not to:

  • Use the Site for any unlawful purpose or in violation of these terms;
  • Attempt to gain unauthorized access to any portion of the Site, its servers, or connected systems;
  • Interfere with, disrupt, or place an unreasonable load on the Site or its infrastructure;
  • Use any automated means (bots, scrapers, etc.) to access or collect data from the Site without our prior written consent;
  • Copy, reproduce, distribute, or create derivative works from Site content except as expressly permitted.

Intellectual Property

The cutta name, logo, brand, music, recordings, artwork, text, graphics, and all other content on the Site are owned by or licensed to cutta and are protected by copyright, trademark, and other intellectual-property laws. Except as expressly permitted, you may not use, reproduce, or distribute any Site content without our prior written permission.

Free Track Downloads — Edits, Remixes & Flips

From time to time the Site offers free downloads of cutta edits, remixes, and flips (“Free Tracks”) in exchange for an email address. By downloading a Free Track, you agree to the following license and terms:

  • Permitted use. You may download and use Free Tracks for your own personal listening and for DJ sets (live or streamed), free of charge.
  • Prohibited use. You may not resell, sublicense, redistribute, re-upload, re-host, or otherwise make a Free Track available to others (including via file-sharing sites, other artists’ releases, compilations, or sample packs), and you may not use a Free Track in advertising, film/TV, video games, or other commercial or monetized productions without cutta’s prior written consent.
  • Third-party rights in remixes. Many Free Tracks are edits, remixes, or flips of pre-existing songs written, recorded, and/or owned by other artists and rights holders. cutta’s license under this section covers only cutta’s own remix/edit contribution. It does not grant, and cutta does not have the authority to grant, any rights in the underlying musical composition or the original master recording. If your intended use goes beyond personal listening and DJ play, you are responsible for independently clearing rights with the original composition and master owners.
  • No warranty. Free Tracks are provided “as is” and “as available,” without warranty of any kind, express or implied, including as to quality, accuracy, non-infringement, or fitness for a particular purpose.
  • Limitation of liability. To the fullest extent permitted by law, cutta is not liable for any damages, claims, or losses arising from your download or use of a Free Track, including any claim arising from your use of a Free Track in violation of this license.
  • Availability. cutta may modify, discontinue, or remove any Free Track, or the download gate itself, at any time without notice.

Original Sample Packs & Loops

Separately, any sample packs, loops, sounds, or other original production materials cutta offers for free download on the Site (“Materials”) are provided for your use in your own original music productions, subject to the following: you may use the Materials royalty-free within your own musical works; you may not resell, redistribute, repackage, or otherwise make the Materials available to others as standalone sounds, samples, or sample packs, whether for free or for sale. The Materials are provided “as is” without warranty of any kind. cutta retains all ownership rights in the Materials.

Store & Merchandise

The Site sells physical merchandise and Sonic System plugin licenses (the “Store”). All prices are in U.S. dollars, and payments are processed securely by Stripe; we never see or store your full card details. This section covers physical merchandise, which is produced and shipped on demand by our fulfillment partner, Printful (Printful receives your name and shipping address solely to produce and deliver your order). Plugin licenses are digital goods governed by the “Sonic System Audio Plugins” section below.

  • Prices & charges. Listed prices are per item and do not include shipping. A flat $6.00 standard shipping charge is added at checkout, and any applicable tax is calculated there, so the full amount you will be charged is shown before you pay. We do not add handling fees, service fees, or any other mandatory charge beyond those shown.
  • Shipping. Delivery estimates shown at checkout are estimates, not guarantees. Production and carrier delays can occur and are outside our control.
  • Returns & replacements. Because each item is printed to order, we do not accept returns or exchanges for buyer’s remorse or incorrect size selection, except where required by law; please check the size guide before ordering. If your item arrives damaged, defective, or misprinted, email mgmt@cuttadj.com within 30 days of delivery with your order number and a photo, and we will replace it or refund you at no cost.
  • Lost orders. If tracking shows your order never arrived, contact us within 30 days of the last tracking update and we will work with you on a replacement.
  • Errors & availability. We may correct pricing or listing errors, limit quantities, and discontinue products at any time; if we cancel your order for any reason you receive a full refund.
  • Taxes. Applicable sales tax, and any customs or import duties on international orders, are the buyer’s responsibility unless collected at checkout.

Sonic System Audio Plugins (Software)

cutta makes a family of desktop audio plugins under the Sonic System name (the “Plugins”). This section governs downloading, trying, and licensing the Plugins, and applies together with the rest of these terms. The Plugins’ optional network features are described in the Privacy Policy (see News Check and Update Check).

  • Try before you buy. Every Plugin can be downloaded and used free of charge as a trial, with every feature enabled. While unlicensed, a Plugin’s audio output briefly mutes (about one and a half seconds every 30 seconds); the trial has no time limit and does not expire. The trial exists so you can confirm, before paying, that a Plugin works in your own setup: your DAW or host, operating system, and hardware. Plugins are also fully unlocked at no charge when running inside the Sonic System (System One) host.
  • What a purchase is. Buying a Plugin is a one-time payment (the price shown at checkout) for a license, not a sale of the software itself. The license is personal, non-exclusive, and non-transferable, and lets you install and use that Plugin, unlocked, on computers you personally own or control, for your own music production, personal or commercial alike. It never expires, has no subscription or recurring fee, and once activated does not require an internet connection. Music and audio you create with the Plugins is entirely yours; cutta claims no rights in it and no royalty is owed.
  • Your license key. Your key is delivered by email, normally within a few minutes of purchase (check your spam folder; if it has not arrived within 24 hours, email mgmt@cuttadj.com and we will sort it out, including re-sending lost keys). Each key is issued to, and encodes, the email address used at checkout. The key is for you alone: you may not publish, share, sell, rent, sublicense, or transfer it. A key that is shared or posted publicly stops being a valid license.
  • What you may not do. You may not redistribute, re-host, resell, or bundle the Plugins or their installers; reverse engineer, decompile, or modify the Plugins except to the extent applicable law expressly permits despite this restriction; or bypass or tamper with the trial or licensing mechanisms.
  • Refunds. Because the unlimited trial lets you fully evaluate a Plugin in your own setup before buying, and a license key is delivered and usable immediately, Plugin purchases are generally final. That said: if your key fails to activate, or a licensed Plugin is materially broken in a way the trial did not show, email us within 30 days of purchase and we will fix the problem or refund you in full. Nothing in this section limits any non-waivable rights you have under applicable law.
  • Updates & versions. Your license covers updates to that Plugin that we make available, at no extra charge. We do not promise any particular future update, feature, or continued development, and we do not guarantee compatibility with any particular DAW, host, or operating-system version, current or future. The optional in-plugin update notice never installs anything by itself (see Update Check), and you may keep using the version you have for as long as you like.
  • Support. Support is provided on a reasonable-efforts basis by email at mgmt@cuttadj.com. We do not guarantee response times or that every issue can be resolved on every system.
  • Warranty & liability. The Plugins are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, cutta is not liable for lost or corrupted projects, sessions, recordings, or other data, lost profits, or any indirect, incidental, special, or consequential damages arising from the Plugins, and cutta’s total liability relating to a Plugin will not exceed the amount you paid for its license. Some jurisdictions do not allow certain warranty exclusions or liability limits, so parts of this may not apply to you.
  • Termination. Your license ends automatically if you materially breach this section (for example, by sharing your key or redistributing the software). On termination you must stop using and delete the unlocked Plugin; provisions that by their nature should survive (including warranty and liability terms) survive.

VST is a registered trademark of Steinberg Media Technologies GmbH. DAW and host names mentioned on the Site or in Plugin materials are trademarks of their respective owners; cutta and the Plugins are not affiliated with or endorsed by them.

Tickets, Events & Third-Party Links

Tour dates, venues, and event information on the Site are provided for convenience and are subject to change or cancellation without notice. Ticket purchases, table reservations, RSVPs, and event admission are handled by third parties (such as ticketing platforms and venues), each with their own terms, policies, and pricing. cutta does not sell tickets directly, is not responsible for third-party transactions, and makes no guarantee regarding event availability, lineups, pricing, refunds, or admission. Any links to third-party websites are provided for convenience only; we do not control and are not responsible for their content, products, or practices.

Advertisements

The Site may display third-party advertisements served through Google. Advertisements are the content of their advertisers: cutta does not review, endorse, or verify advertiser content, and the appearance of an ad on the Site does not constitute a recommendation or endorsement by cutta. Any dealings between you and an advertiser, including payment for and delivery of goods or services, are solely between you and that advertiser. To the fullest extent permitted by law, cutta is not liable for advertiser products, services, or claims. Ads on the Site may be personalized based on your prior visits to this and other websites; see the Advertising section of the Privacy Policy for what is collected and how to opt out.

Disclaimer of Warranties

The Site, the Plugins, and all content are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Site will be uninterrupted, secure, or error-free.

Limitation of Liability

To the fullest extent permitted by law, cutta and its affiliates, agents, and representatives will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Site, the Plugins, third-party events or tickets, or any content or Materials, even if advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless cutta from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these terms, or your violation of any rights of a third party.

Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Massachusetts.

02Privacy Policy

We respect your privacy. This policy explains what information we collect, how we use it, and your choices.

Information We Collect

  • Information you provide: when you subscribe to updates, we collect your email address (and your name, if you provide it). When you contact us, we receive the information you choose to send.
  • Free downloads: unlocking a free track download requires an email address. That email is added to the cutta mailing list under the same terms as a newsletter signup (see “Email & Marketing” below); no other personal information is collected as part of the download itself.
  • Store purchases: when you buy merchandise, your payment details go directly to Stripe (we never see your full card number), and your name, email, and shipping address are shared with Stripe and our fulfillment partner Printful solely to process, produce, ship, and support your order.
  • Plugin license purchases: when you buy a Sonic System plugin license, payment is processed by Stripe the same way, and the email address you use at checkout is used to create and deliver your license key. The key itself encodes that email address (that is how a plugin can show who it is licensed to); it is not sent anywhere by the plugin. The key email is delivered through our email-delivery provider, and buying a plugin license does not add you to the newsletter.
  • Automatically collected: like most websites, basic technical information (such as IP address, browser type, and pages visited) may be logged by our hosting and security provider to operate and protect the Site.

Sonic System Plugins: News Check

Our Sonic System desktop audio plugins can display short product news inside the plugin. To do this, an installed plugin downloads a small public news file from this Site (cuttadj.com/news/sonic-system.json) at most once per day.

  • What is sent: nothing about you. The request contains no account details, no license information, no usage data, and no identifiers of any kind. It is an ordinary, anonymous web request for a static file, the same as loading a page of this Site in your browser, made over an encrypted (HTTPS) connection.
  • What is logged: as with any web request, our hosting and security provider (Cloudflare) sees the requesting IP address in its ordinary server logs, which are used only to operate and protect the Site. We do not use these logs to identify or track plugin users.
  • What is stored: the downloaded news file is cached on your own computer so the plugin does not re-fetch it needlessly. You can delete it at any time.
  • Your choices: the check is read-only and sends no personal information, and it is optional. Every plugin that includes the news check also includes a small “news: on / off” setting in its license panel; switching it off stops the check entirely, and the choice is saved on your own computer (where it is shared by the Sonic System plugins installed there) until you switch it back on. If you prefer that a plugin never connect to the internet at all, you can also block it with your operating system’s firewall. The plugins remain fully functional without the news check.

If this mechanism ever changes to collect anything more, we will update this policy before doing so.

Sonic System Plugins: Update Check

Our Sonic System desktop audio plugins can also let you know when a newer version of that plugin is available. To do this, an installed plugin downloads a small public version list from this Site (cuttadj.com/plugins/versions.json) at most once per day and compares it against the version you are running.

  • What is sent: nothing about you. Exactly like the news check above, the request contains no account details, no license information, no usage data, and no identifiers of any kind. It is an ordinary, anonymous web request for a static file, made over an encrypted (HTTPS) connection.
  • What is logged: as with any web request, our hosting and security provider (Cloudflare) sees the requesting IP address in its ordinary server logs, which are used only to operate and protect the Site. We do not use these logs to identify or track plugin users.
  • What is stored: the downloaded version list is cached on your own computer, together with your update-prompt preferences. You can delete these files at any time.
  • Nothing installs itself: the plugin never downloads or installs software on its own. If a newer version is listed, the plugin shows a small “update now?” prompt inside its own window with three choices: update (which simply opens the download page in your web browser, where installing remains entirely your manual action), later, or never ask. Declining an update never limits the plugin; you can keep using the version you have for as long as you like.
  • Your choices: choosing “never ask” turns off both the prompt and the automatic daily check for that plugin, and the choice is saved on your own computer until you change it. Every plugin that includes the update check also keeps a small “updates” control in its license panel that performs a check only when you click it, so you can stay on a version you like and still look for updates whenever you choose. As with the news check, you can also block the plugin with your operating system’s firewall; the plugins remain fully functional without the update check.

If this mechanism ever changes to collect anything more, or to deliver software rather than a notice, we will update this policy before doing so.

How We Use Your Information

  • To send you news, updates, releases, and event announcements you’ve signed up for;
  • To respond to your inquiries;
  • To operate, maintain, secure, and improve the Site.

Email & Marketing

If you subscribe, you consent to receive emails from cutta. Every email includes an unsubscribe link, and you can opt out at any time. You may also email us to be removed.

Service Providers

We use trusted third-party services to run the Site and our mailing list, for example, hosting and security providers, and an email-delivery provider used to send our newsletters. These providers process information only as needed to provide their services. We do not sell your personal information for money; for how personalized advertising is treated under California law, see the Advertising section below.

Cookies

The Site itself sets minimal cookies or similar technologies necessary for its basic operation and security. Separately, Google’s advertising script and the Meta (Facebook/Instagram) advertising pixel each set third-party cookies and similar identifiers, described in the Advertising section below. The embedded video players (YouTube, and Twitch while a live stream is showing) can also set third-party cookies, but only if you click play, as described in the Live Stream section. You can control cookies through your browser settings.

Recommendations (our own promo card)

Some pages show a small card promoting our own things (a release, the store, the mailing list). Which one you see is chosen by software we run ourselves at adamp.cuttadj.com. It is not an ad network, no outside advertiser is involved, and it does not build a profile that follows you across other websites.

To make that choice it receives only: whether you are on a phone or a desktop, the hour of day, and which slot on the page the card sits in. It does not receive your name, your postal address, or your payment details.

It stores two small values in your own browser: the id of the last card you were shown (so a click can be matched to the right card) and, if you dismiss the card, a note not to show it again for the rest of your visit. Clearing site data in your browser removes both.

If you subscribe to the mailing list, that same software is told a subscription happened, so it can learn which promo led to it. Your email address is hashed (converted one way, so it cannot be read back) before it is sent, and it is sent only to our own server. We do not send your email address to advertisers.

The same software also receives a small aggregate signal about the Google ads described in the Advertising section below: whether an ad unit displayed or not (Google’s own fill status) and whether an ad appears to have been clicked (inferred from the page losing focus while your pointer is over an ad). These signals are bucketed only by site, device type, and time-of-day band. They contain no identifiers and no per-visitor records, set no cookies of their own, are sent only to our own server, and are not shared with any third party.

Live Stream (Twitch)

When cutta is streaming, the featured video on the home page shows a Live on Twitch badge. To decide whether to show that badge, the Site asks our own server whether the channel is currently live. That check happens server-side and sends nothing about you to Twitch or anyone else.

Nothing loads from Twitch until you click play. The badge on its own makes no request to Twitch. If you do click play, the Twitch player is embedded in the page, and at that point Twitch (Amazon) receives your IP address, your browser and device information, and the address of the page you are on, and it may set its own cookies or similar identifiers. In that moment Twitch is acting on its own behalf under its own privacy notice, which we do not control. If you would rather not load it, do not click play.

When the stream ends, the badge disappears and the featured video reverts to the YouTube embed. The same rule applies there: YouTube (Google) is only contacted if you click play on that player.

Advertising

This Site uses Google to serve advertising. Google’s advertising script loads on the pages of this Site, and ad units may appear on any page of the Site. Third-party vendors, including Google, use cookies and similar technologies to serve ads based on your prior visits to this and other websites.

This Site also loads the Meta (Facebook/Instagram) advertising pixel on its pages. The pixel reports your visit and the pages you view to Meta, so that advertising for cutta can be measured and targeted on Meta’s platforms, including to people who have visited this Site before. Meta is a recipient of the information described in the next paragraph.

For advertising, the categories of information collected by Google, Meta, and their partners include online identifiers (such as cookie IDs and advertising IDs), IP address, device and browser information, and information about your activity on this Site, such as the pages you view. We do not give advertisers your name, your email address, or your order details.

Google’s use of advertising cookies enables it and its partners to serve ads to you based on your visit to this Site and/or other sites on the Internet. You can opt out of personalized advertising by visiting Google Ads Settings, and you can opt out of some third-party vendors’ use of cookies for personalized advertising at aboutads.info/choices.

California residents. Serving personalized ads involves "sharing" your personal information for cross-context behavioural advertising as those terms are used in the CCPA/CPRA. We do not sell your personal information for money. To opt out, use Do Not Sell or Share My Personal Information below, or enable a browser-level opt-out signal such as Global Privacy Control (GPC), which we honour. When your browser sends a GPC signal, this Site turns off personalized advertising and does not load the Meta pixel for that visit, and it tells you on the page that the signal was honoured.

Do Not Sell or Share My Personal Information. Email mgmt@cuttadj.com with the subject "Do Not Sell or Share" and we will apply the opt-out. You can also opt out on this device by turning on Global Privacy Control in your browser (this Site honours it automatically), via Google Ads Settings, and for Meta via your Meta ad preferences.

If you are in the European Economic Area, the United Kingdom, or Switzerland, you will be asked for your consent choices before personalized ads are shown, and you can change those choices at any time.

We do not share your email address or any information you give us (for example, when subscribing or buying) with advertisers.

Data Retention & Security

We retain subscriber information for as long as you remain subscribed or as needed for the purposes described above, and we take reasonable measures to protect it. No method of transmission or storage is 100% secure, however, and we cannot guarantee absolute security.

Your Rights

You may request to access, correct, or delete your personal information, or to unsubscribe, by emailing us at mgmt@cuttadj.com. Depending on where you live, you may have additional rights under applicable privacy laws.

Children

The Site is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us information, please contact us and we will delete it.

Changes

We may update this Privacy Policy from time to time. Changes are effective when posted on this page.

General

All information on the Site is provided in good faith for general informational and promotional purposes only. We make no representation or warranty of any kind regarding the accuracy, adequacy, validity, reliability, or completeness of any information on the Site.

Events & Tickets

Event dates, times, venues, lineups, and ticketing are controlled by third parties and may change or be cancelled at any time without notice. cutta is not responsible for, and disclaims all liability relating to, third-party events, ticket sales, venue policies, refunds, or admission decisions.

Tour listings on the Site are maintained automatically. A date is removed from the tour list and the tour globe once that performance has ended, so the listings shown are intended to be upcoming dates only; the absence of a past date is not a statement that it did not take place. A date that is cancelled or postponed is not silently removed: it remains listed and clearly marked as cancelled or postponed, with its ticket or reservation link withdrawn, until the original date has passed. Listings are published in good faith from the schedule we hold and may lag a change made by the venue or promoter, so always confirm with the venue or ticket seller before travelling. If you hold a ticket or reservation for a date that changes, refunds and rescheduling are handled by the venue or ticket seller under their own policies, not by us.

External Links

The Site may contain links to external websites and platforms (including social media, ticketing, and streaming services) that are not operated by us. We are not responsible for the content, accuracy, privacy practices, or availability of those sites.

Third-Party Advertisements

The Site may display advertisements served by third parties, including Google. Advertiser content is created and controlled by the advertisers; its appearance on the Site is not a recommendation or endorsement by cutta, and we make no representation about any advertised product, service, or claim. Audio Software

The Sonic System plugins are audio tools that can produce loud or unexpected sounds, particularly at high gain, resonance, feedback, or distortion settings. Protect your hearing and your equipment: start at low monitoring levels when trying a new plugin or preset. To the fullest extent permitted by law, cutta is not responsible for hearing injury, damage to speakers, headphones, or other equipment, or lost or corrupted projects, sessions, or audio arising from use of the plugins. Audio-software behavior can vary across DAWs, hosts, operating systems, and hardware; the free trial exists precisely so you can verify stability and compatibility in your own setup before purchasing, and we recommend saving your work often and keeping backups of important sessions.

04DMCA / Copyright Notice

cutta respects the intellectual property rights of others and expects Site users to do the same. If you believe content on the Site infringes your copyright, send a written notice to mgmt@cuttadj.com that includes:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material you claim is infringing, and its location on the Site (e.g., a URL);
  • Your contact information, including address, telephone number, and email address;
